Membership Cancellation Request.


In accordance with the Axis Performance Terms and Conditions of Membership, please note that in order to meet cancellation request criteria, the below requirements must be met.

a. During Cooling Off Period: Your membership is subject to a 48 Hours cooling off period. The cooling off period starts from the date the agreement is entered into (the “commencement date”) and ends at close of business up to 48 Hours later and may be terminated under the following conditions:

i. All monies paid will be refunded with the exception of an administration fee of $79 if any goods or merchandise you received on joining are not returned or cannot be returned.

ii. Axis will charge an additional payment to recover costs in relation to any services provided to the member within this period. Axis requires a correctly dated written request to terminate the membership within the timeframe specified as the cooling off period from signing the membership agreement.

iii. Axis will charge an additional payment to recover costs in relation to any services provided to the member within this period.

b. Outside Cooling Off Period: Your membership may be terminated under the following conditions outside of the cooling off period:

i. Permanent Sickness or Physical Incapacity:

ii. Axis requires a completed cancellation request form advising the nature of the illness or physical incapacity, outlining specifically how this prevents you from utilising your membership services.

iii. Axis requires a medical certificate stating that you cannot utilise the services included in your membership because of your permanent illness or physical incapacity.

c. Cancellation for any other reason :

i. Axis requires that a cancellation request form (below) be completed and and membership fees must be paid in full to the amount specified on your membership agreement form.

ii. As Axis Performance memberships deliver coaching services or recovery services and not gym memberships for the independent use of gym equipment, Axis Performance members are ineligible for the exemption of paying the full membership due to moving over 25km away due to the memberships services still being available to members either residing further away or remotely.

d. Cancellation within Minimum Term:

i. The member may terminate this Agreement before the expiry of their minimum term if all instalments and fees are paid in full to the total value of the agreement.

ii. Any instalments/fees due at the date of termination (including instalments/fees which fall due during any notice period) will remain a debt owed to and recoverable by Axis Performance and/or a debt collection agency. The Member shall not consider that this Agreement has been terminated until such time as all fees are paid in full and with written confirmation from Axis Performance.

e. Termination by Axis Performance. Axis Performance reserves the right to terminate this membership agreement in accordance with the following conditions:

i. Failure to abide by any of the criteria listed in the Conditions of Entry or the items listed in this agreement.

ii. Action upon a complaint by either a Club member, an employee or a representative contractor of Axis Performance.

f. Cancelling a booking:

i. If you need to cancel or reschedule an Axis Performance booking or appointment, please note that a minimum of 24 hours notice is required for all services excluding both the Athlete Development Program and the Performance Rehab Program bookings, where 2 full business days (48 hours) notice is required due to the significant preparatory work conducted by Axis Performance team members in order to prepare for such bookings.

ii. Less than the minimum amount of notice being provided will lead to the booking/ appointment and any related payment to be forfeited or owed in full. Failing to attend a booked membership covered booking (no show) will incur a $25 fee to be added to the next scheduled direct debit.

Once your cancellation request (below form) is received and processed, you will receive an email confirmation on the status of your request.
